Terms and Conditions

This site is owned by Dacha Group Ltd (hereafter D2TIME) and registered in England, Registration No. 9694263, with registered address at 8th Floor, Suite 4, St.James's House, Pendleton Way, Salford, M6 5FW, United Kingdom (hereafter D2TIME), and email address at customer.services@d2time.co.uk.

Any purchase of goods from the site [www.d2time.co.uk] requires the customer to consult and accept these terms and conditions. The click validating the order implies full acceptance of these terms and represents the customer's "digital signature".


Purpose

These terms and conditions are intended to define the rights and obligations of the parties in the sale of goods proposed online by d2time for the customer.


Order Confirmation and Payment

We accept most common forms of electronic payments including but not limited to VISA, MASTERCARD, AMERICAN EXPRESS,DINERS, JCB and PayPal. Any charges for payments on credit cards will be added to the total order amount and notified to you before you place an order. D2time use SSL encryption on all transactions and are secured.


All credit/ debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to, or does not , for any reason authorise payment- D2TIME will not be liable for any delay or non-delivery. We may also need to use extra security steps through Verified by VISA, MasterCard SecureCode or American Express SafeKey.

At the time of ordering, we will contact your card issuer to authorise payments' and validate that you have sufficient funds. Should the card issuer authorise the payment, we will place on hold  those funds to ensure they can be debited at the time of despatch. This means you will be unable to access those funds within your account. No charge will be made until your order is despatched


Should D2TIME cancel your order, we will release the hold that we have on any funds. Please be aware that dependant on your bank, it may take up-to 5 working days before those funds are cleared again in your account.

All contractual information will be confirmed by email to the address specified by the customer during the purchasing act.


Proof of Transaction

The records stored in D2TIME's computer systems under reasonable safety conditions are considered proof of communications, orders and payments made between the parties.

Purchase orders, invoices and delivery notes are stored on a reliable and durable system and can be produced as evidence.


Product Information

Every effort has been made to ensure the accuracy of the information presented on WWW.D2TIME.CO.UK. D2TIME or its suppliers shall not be held liable for the consequences, accidents, or special damages arising from electronic transmissions or the accuracy of transmitted information, even in cases where D2TIME was aware of the possibility of such damages. Manufacturer and brand names are only used for identification purposes. Product photos, descriptions and prices are non-contractual.


Validity Period of Offer/Sales and Prices

Our offers/sales and prices are valid for the day the site is consulted and are subject to change without notice. Sale items cannot be purchased in conjuction with other offers or discount code. This does not affect your statutory rights


Delivery Terms

Products are delivered to the address specified by the customer on the purchase order and only to geographic zones that we service.

Please note that whilst every effort is made to ensure all products leave our premises in perfect condition, on the rare occassion that it isn't 100% right, the customer must notify the carrier (or postman) of even the slightest trace of damage (holes, signs of crushing, etc.) to the parcel, and refuse the package if necessary. A new, identical product will then be sent to the customer at no additional charge.

No exchanges can be made at a later time for goods claiming to be damaged during carriage without notification at the time of reception.

As with any shipment, a delay or loss of goods is possible. In such a case, the carrier shall start an investigation. Every effort is made, for as long as necessary, to find the package. If the package is not found, the carrier will reimburse D2TIME, who will deliver a new, identical package to the customer free of charge.

We shall not be held responsible for delayed delivery times due to the carrier, including for the loss of goods, bad weather or strikes.



Loss or Damage in Transit

D2TIME will not be responsible for damage or loss of goods or part thereof in transit or for any discrepancy between the goods delivered and the goods ordered unless the customer gives written or email notice of a claim to D2TIME and the carrier within three (3) business days of delivery.

In the event of damage of goods or part thereof in transit or for any discrepancy between the goods delivered and the goods ordered, the customer must hold the goods and make them available for inspection or collection by D2TIME or its representatives on request.



Delivery Errors

The customer must inform D2TIME immediately (the same day or, at the latest, the first business day following delivery) concerning any claim of delivery error or non-conformity of goods, in kind or in quality, compared with the information on the purchase order.

Any claim made after this time period will be rejected subject to D2TIME Customer Services Manager decision .

All claims must be made in writing and sent to customer.services@d2time.co.uk or Customer Services Dept, 8th Floor, Suite 4, St James's House, Pendleton Way, Salford, M6 5FW, United Kingdom.

Any claim that does not respect the rules defined above cannot be taken into account and releases D2TIME of any responsibility to the customer.

In the case of delivery error or exchange, all goods to be exchanged or refunded must be returned to D2TIME in whole, in its original packaging and in perfect condition to Customer Services Dept,8th Floor, Suite 4, St James's House, Pendleton Way, Salford, M6 5FW, United Kingdom.

For claims to be accepted, the customer must first make a declaration to D2TIME concerning any returns and receive and D2TIME's consent. If accepted, the customer will ship the package to Customer Services Dept,8th Floor, Suite 4, St James's House, Pendleton Way, Salford, M6 5FW, United Kingdom.

Shipping fees shall be at D2TIME's expense, except in the case where the goods do not correspond to the original declaration made by the customer concerning the return.


Warranty and Repairs

The provisions hereof cannot deprive the customer of their right to legal warranty requiring D2TIME to protect the customer against latent defects of goods sold.The warranty we offer on goods sold cover everything apart from general wear and tear, bracelet and watch case.

The customer is expressly informed that D2TIME is not the manufacturer of the goods presented in WWW.D2TIME.CO.UK and that D2TIME shall not be held liable for defective goods.

In the case of damage to a person or property resulting from a product defect, only the product manufacturer shall be held liable and sought after by the customer, by means of the information provided on the packaging of said product.

All products sold on WWW.D2TIME.CO.UK are under a two (2) year warranty. Please note that if you have you item altered, repaired, or adjusted by another jeweller or company, then this will invalidate your warranty and render it void. To protect the warranty, work must be carried out by a third party company authorised and working on behalf of D2TIME. Watch repairs are warranted for two years against defects from workmanship. Our warranty does not cover the batteries, crystals, straps, case covers or damage to teh movement caused by humidity  or moisture due to mishandling.

Unclaimed repairs for watches that have been issued invoices for payments that have not been paid, the watches are destroyed after 21 DAYS due to availability of storage space. Where customers have been intouch with our customer services team, a note will be added to the system to advusee the watch technicians on the new status of the repaired watch which will be normally extended for a maximum of 7 DAYS.


Right to Withdrawal

In accordance with the Consumer Contracts Regulations, the customer has the right to a cooling off period of fourteen (14) business days, starting at the time goods are received, to cancel the contract and return said goods at their own expense, without having to give a reason. All returns can be indicated beforehand with D2TIME customer service department. All goods must be returned to D2Time, Returns Customer Services Dept, 8th Floor, Suite 4, St James's House, Pendleton Way, Salford, M6 5FW, United Kingdom.

The cooling off period and right to cancel do not apply to contracts or orders for any goods made to your specification.

Only complete and unused goods in perfect condition for resale will be accepted. No refunds or exchanges will be made for incomplete, damaged or unsealed goods, including damage to original packaging. The customer can exercise this right to withdrawal without penalty, excepting the return fee for the goods. If the customer exercises the right to withdrawal, they have the option of requesting a full refund or exchange of goods. If an exchange is requested, all shipping expenses shall be the responsibility of the customer.

If the right to withdrawal is exercised, D2TIME will make every effort to refund the customer within 10 days. The refund will be applied to the original card used to place your order.


Our Liability

D2TIME is solely responsible for transaction delivery, refunds and chargebacks.


Force Majeure

Neither party will be deemed to be in breach of any of its obligations under the agreement as a result of any delay in performing or any failure to perform any such obligations by reason of any cause or event beyond the parties' control. A force majeure event includes, but is not limited to, any unforeseeable, inevitable, or unstoppable act, event, non-happening, omission or accident beyond the control of either party, despite all reasonable efforts made to the contrary. In addition to events usually recognized by the British courts, a force majeure event includes in particular (without limitation) the following: Strike, lock-out, earthquake, fire, storm, flood, lightning, explosion, impossibility of the use of public or private telecommunications networks.

In such circumstances, the party delayed or unable to perform ("Delayed Party") shall notify the other party ("Affected Party") within ten (10) business days following the date such events become known.


Intellectual Property

You acknowledge and agree that all copyright, trademarks and all other Intellectual Property rights in all material or content supplied as part of the website shall remain always vested in D2TIME. You are permitted to use this material only as expressly authorised by D2TIME.

You acknowledge and agree that the material and content contained within the website is made available for your personal non-commercial use only and that you may (if necessary to make an order) download such material and content onto your personal computer for such purposes. Any other use of the material and content of the website is strictly prohibited.

You agree not to (and agree to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

D2TIME does not operate or control the information, product(s) and or services found on any external sites. D2TIME do not represent  or endorse the accuracy or reliability of any information, products and or, services on external sites. 

- Users assume complete responsibility and risk in their use of any external sites.

Data Protection

All personal data you provide us is used to process your orders. This data will be treated in accordance with the Data Protection principles outlined in the Data Protection Act. For your information, please refer to the Privacy and Cookies Policy.


Applicable Law and Competent Jurisdiction

In form and content, these Terms and Conditions shall be governed by and construed in accordance with English law. All orders placed on WWW.D2TIME.CO.UK strictly imply the acceptance of D2TIME's terms and conditions.

In case of dispute or claim, the customer agrees to seek an amicable solution with D2TIME before proceeding with any legal action. In the event where such a solution cannot be found, any disputes concerning the sale (price, terms and conditions, products, etc.) will be subject to the exclusive jurisdiction of the English courts.
